Shirley Lin Assesses Discriminatory Intent in Job Postings

Former Fellow Shirley Lin (’11), an acting assistant professor at New York University School of Law, was interviewed for a Bloomberg Law story about companies having the upper hand when defending against bias lawsuits (“Facebook Job Ad Bias Claims Would Be Tough To Prove, Lawyers Say,” Oct. 2). One obstacle that plaintiffs alleging that job postings are discriminatory must overcome, Shirley said, is that the Equal Employment Opportunity Commission will evaluate the entirety of an employer’s recruiting efforts, “given that employers may supplement recruitment efforts to ensure a broader pool.”
